Corrections..Changes..Updates

Now that all of our bills are moving to the Governor's desk some corrections, changes and updates are in order. Instead of relisting every bill here, I'm editing the May 24th post with these. Just look down below for the RED , PURPLE and GREEN highlights to see what's happened.

Heading To The Governor’s Desk!!!

Well all of our bills have moved on. Unfortunately a number of them have been saddled with amendments that have ruined their initial intent, restricted their effectiveness, or are totally unnecessary.

For example; S.B. 92 which initially was to remove the exemption to pre-emption that Clark County has enjoyed was changed to provide relief to everyone but Clark County residents. Firearms will still have to be registered, but under the attached amendment registration now has to be within 60 days and 72 hours for newly acquired handguns. This means that gun shows, trade shows, visitors, etc. are exempt if they’re here less than a couple of months, but Clark County residents still must register their handguns.

We’re told that this is “the best we could do” by those in the know. The many Clark County residents who voiced their opposition to this amendment were ignored by those in power. I just don’t understand how a bill with 28 cosponsors couldn’t get through in its original form. I think this alone is a pretty good commentary on what really happens in Carson City.

We’re being told that S.B. 92 is “progress”. I can’t agree. It’s just power politics played by real professionals.

S.B. 237 suffered a similar fate. The bill that would finally recognize CCW’s from other states had an excellent provision that would have removed the listing of each and every firearm that a person wished to carry concealed. Instead of a listing, the CCW permit holder would only have had to qualify on a category of firearms; revolver, semiautomatic, or both. No, that just wouldn’t do. The Chairman of the Assembly Judiciary Committee amended the bill so that only revolvers will be qualified by category. Semiautomatics still will require each individual firearm to be qualified and listed separately by make, model and caliber. Oh well, politics as usual.

Here’s a rundown of the rest of our bills: (click on the bill number for the final bill with amendments)

A.B. 91, the “explosives bill” was passed out of the Senate floor today by a unanimous vote. The amendments did not change any of the intent of the bill. Reloading hobbyists are not affected. It is now headed to the Governor for his signature. UPDATE!!...Signed by Governor 6/1 and goes into effect 10/1/07.

A.B. 95, the anti confiscation bill was passed out of the Senate floor on May 17th with a unanimous vote. The amendments attached were more procedural than anything else. It was enrolled yesterday and is scheduled to go to the Governor’s desk for signature. UPDATE!!...Governor Jim Gibbons signed this bill into law 5/25! It goes into effect immediately!!


A.B. 107, the “dangerous knife” bill was passed with amendment from the Senate Judiciary committee to the floor of the Senate. The definition of “dangerous knife” still measures from the point to the hinge and prohibits any blade longer than 2”. This bill will probably be voted on by the complete Senate tomorrow. UPDATE!!...It appears that this bill has died on the floor of the Senate on 5/26!! This is GREAT NEWS! THE 2" REQUIREMENT WAS JUST WRONG.

A.B. 194, the bill that restricts possession of a firearm during a court issued order of protection in a domestic violence situation was passed from the Senate floor today on a 20-1 vote. The major change on this is that it now doesn’t prohibit ownership of a firearm, just the possession of one during the order of protection. (at least that’s how I read it). UPDATE!!..Signed by Governor Gibbons 6/2 and goes into effect 10/1/07.
A.B. 259, the NDOW accounting bill was passed on the floor of the Senate yesterday and enrolled. UPDATE!!..The governor signed it on 6/2 and it is effective 7/1/07.

A.B. 343, this is the bill that would change the residency requirement change for discounted hunting and fishing licenses. This is still in the Ways and Means Committee. No action has been taken on it yet. UPDATE!!...This bill died in the Ways and Means Committee.

S.B. 92, SEE ABOVE. The bill was passed by the Assembly unanimously. UPDATE!!..The bill was delivered to the governor May 30th and is still waiting to be signed. UPDATE!!...The Governor signed into law 6/4 with an effective date of 10/1/07.

S.B. 237, SEE ABOVE. This bill passed on the Assembly floor unanimously. UPDATE!!..This bill was delivered to the governor on May 31st and is still waiting to be signed. UPDATE!!..The governor has until 6/15 to sign, not sign, or veto. No indication on what he will do.

S.B 354 , changes to a Category E felony the possession of a firearm on school campuses, etc. It has passed out of the Assembly Judiciary Committee and is waiting on an Assembly floor vote that should take place tomorrow. UPDATE!!--Passed in Assembly 5/25. The Category E felony provision was dropped and instead this stays as a gross misdemeanor. This is much better. UPDATE!!..THE BILL WAS REFERRED TO CONFERENCE ON 6/2 AND MAY NOT MAKE IT OUT BY SINE DIE!! Bill forwarded to the governor 6/4

Other than S.B. 92 and S.B. 237 our bills have fared pretty well. Now let’s see if Governor Gibbons agrees.

UnFrickin’ Believable!! All Bills Advanced!!

All Hell broke loose this past week as the various committees had to pass their bills out by Friday or they would die. It looks like every one of the bills we’ve been following is moving forward!! In addition, each of the bills was amended before receiving a “Do Pass”. The links do not connect to the amendments or the amended bill. When we know what the amendments are, we’ll post here.

A.B. 91, the “explosives bill” was heard in the Senate Transportation and Homeland Security Committee on May 15th. The bill was amended and given a “Do Pass”.

A.B. 95, the anti confiscation bill was heard in the Senate Judiciary committee on May 11th. The committee took testimony from just two proponents, Assemblywoman Valerie Weber the sponsor of the bill and Art Dixon a friend of SECTION 11. In an almost unprecedented move the committee voted the bill to the floor of the Senate with a “Do Pass” recommendation. The vote was unanimous!!

A.B. 107, the “dangerous knife” in schools bill was heard by the Senate Judiciary committee on May 15th. The bill was amended and given a “Do Pass”. Let’s hope the amendment modifies the 2” limitation.

A.B. 194, the bill that changes possession of a firearm during a court issued order of protection in a domestic violence situation. This bill was heard in the Senate Judiciary Committee on May 15th. The bill was amended and given a “Do Pass”.

A.B 259, NDOW accounting bill (formerly a Mountain Lion hunting bill!) was sent out of the Assembly Ways and Means Committee May 4th with a “Do Pass” recommendation. It is waiting on a floor vote.

A.B. 343, the residency requirement change for discounted hunting and fishing licenses. It had its only hearing in the Assembly Ways and Means Committee on April 26th, but nothing further has been done.

S.B. 92, the elimination of the pre-emption exemption for Clark County that was amended to help everyone but the citizens of Clark County in the Senate, was heard in the Assembly Government Affairs Committee on May 16th. The committee amended it, again, and it was given a “Do Pass”. My only hope is that when we see the amendments that the Government Affairs Committee tacked on we will see the bill restored to it’s original intent, the elimination of the despised “Blue Card” requirements.

S.B. 237, the reciprocity bill with the elimination of certain requirements for CCW’s. This bill was heard in the Assembly Judiciary Committee on May 18th. Your voices were heard! As of Thursday, May 17th, this bill was dead! Impassioned requests made to the committee and it’s chairman, Bernie Anderson, paid off!! The committee amended the bill and gave it a “Do Pass”!! Let’s hope that the amendments aren’t deal breakers.

S.B. 354, changing to a Category E felony the possession of a firearm on school campuses, etc. This bill was heard in the Assembly Judiciary Committee on May 18th, amended and given a “Do Pass”.

All-in-all it was a FABULOUS week!! Now we’ve got to watch the floor agendas in the Senate and Assembly to be certain that our bills move forward. We have only until May 25th for passage or they will be lost. Keep watching SECTION 11 for the current status of these bills.

I Think We’re Winning!!

Last week was very busy for firearms related legislation. We had hearings in several committees concerning some of our key bills. Here’s what we know so far:

A.B. 91, the “explosives bill” was heard in the Senate Transportation and Homeland Security Committee on May 8th. No action was taken at that time.

A.B. 95, the anti confiscation bill was heard in the Senate Judiciary committee on May 11th. The committee took testimony from just two proponents, Assemblywoman Valerie Weber the sponsor of the bill and Art Dixon a friend of SECTION 11. In an almost unprecedented move the committee stopped hearing testimony and voted the bill to the floor of the Senate with a “Do Pass” recommendation. The vote was unanimous!!

A.B. 107, the “dangerous knife” in schools bill was heard by the Senate Judiciary committee on May 8th. No action was taken at that time. It was heard again on May 11th and still no action was taken. Maybe this is a good thing as the provision about 2” knives is just stupid!

A.B. 194, the bill that changes possession of a firearm during a court issued order of protection in a domestic violence situation. This bill was heard in the Senate Judiciary Committee on May 8th. No action was taken at that time.

A.B 259, NDOW accounting bill (formerly a Mountain Lion hunting bill!) passed out the Assembly Ways and Means Committee May 4th with a “Do Pass” recommendation. I have no idea where this bill is right now.

S.B. 92, the elimination of the pre-emption exemption for Clark County that was gutted like a carp, was heard in the Assembly Government Affairs Committee on May 10th. I understand that there was some excellent testimony asking that the bill be restored to its original form. The committee took no action on the bill at this time. (Rumor has it that there may be some amendments coming out of the committee to make this bill more acceptable to Clark County residents, more when we know more!!)

S.B. 237, the reciprocity bill with the elimination of certain requirements for CCW’s. This bill was heard in the Assembly Judiciary Committee on May 9th. No action was taken at that time.

S.B. 354, changing to a Category E felony the possession of a firearm on school campuses, etc. This bill was heard in the Assembly Judiciary Committee on May 9th. No action was taken at that time.

That’s where all of our bills now stand. I’m positive about A.B. 95. I think that will pass on the Senate floor and will go to the governor.

Good Stuff Coming Soon!!

Here it is another week of the Nevada Legislature gone by and not much has happened. Next week, however, a lot of our bills are seeing daylight.

A.B. 91, the “explosives bill” will be heard by the Senate Transportation and Homeland Security Committee next Tuesday, May 8th. As mentioned, we have been assured that hobbyist reloaders will be unaffected by it. Click on the bill number to see the amended bill that will be discussed.

A.B. 95, the anti confiscation bill will be heard in the Senate Judiciary Committee on Thursday, May 10th. There seems to be a lot of support for this bill—or at least no active opposition. I’m hopeful that it will be given a “do pass”. Click on the bill number to see the amended bill.

A.B. 107, the “dangerous knife” in schools bill. This will be heard on Tuesday, May 8th in the Senate Judiciary Committee. If you remember this is the bill that restricts pocketknives on school campuses, on school property, and at public areas that host school events to less than 2” in length. It goes into a bunch of technicalities, but the bottom line is that if you carry a Boy Scout knife you’ll be a criminal. Let’s try and get this thing fixed or dropped.

A.B. 259 is the bill that changed from a Mountain Lion hunting bill to an NDOW accounting bill. Check it out by clicking on the bill number. I have no opinion on this one way or another. The Assembly Ways and Means Committee heard it on 4/26 and no action was taken. I have no idea how this works, but Ways and Means is continuing to act on Assembly Bills after the deadline. If someone knows the inner workings of this, please let us know.

A.B. 343 is another bill sitting in the Assembly Ways and Means Committee after the deadline, but not dead. It also has had a hearing on 4/26. This is the bill that changes the residency requirements for discounted hunting and fishing licenses.

S.B. 92 is up for its Assembly hearing on Thursday, May 10th. I hate what happened to our bill that would have eliminated Clark County’s pre-emption exemption. It now helps everyone but Clark County residents. There is a move by some friends of mine to try and get this bill back to its original intent. Unfortunately I think that the “fix” is in and it’s going to pass in its current form or die. I say the Hell with it! Let’s all go to the hearing in the Assembly Government Affairs Committee on Thursday and tell them we want handgun registration for Clark County residents eliminated!! Bombard the committee members with emails, letters, and even long distance phone calls. Let these guys know that no matter what arrangement was made when Bugsy Siegel was running the show; it is now time for this restraint of our Section 11 and 2nd Amendment rights to be tossed out on its kiester.

Apparently the opposition to our constitutional rights is coming from Sheriff Bill Gillespie, the Gaming Industry, and other assorted do-gooders. Let’s let them know that we are not going down without a fight!

The last two bill that we’re following, S.B. 237 and S.B. 354 are still waiting to be heard in the Assembly Judiciary Committee. No dates have been set.

I’m not a conspiracy theorist, but does anyone think it odd that the “anti confiscation” bill and the bill that would enable confiscation are both being heard on the same day, but in different committees? I guess it’s just the luck of the draw.
